When you create an account, you agree to provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
You agree to notify us promptly of any unauthorized access or use of your account.
2. Description of the Service
Pibliotheca is a software platform designed to support libraries, collections, and related organizational services. The Service may evolve over time, and we reserve the right to modify, suspend, or discontinue any feature at any time.
3. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or abusive purpose
- Interfere with or disrupt the operation or security of the Service
- Attempt to gain unauthorized access to systems, data, or accounts
- Upload malware, malicious code, or harmful content
- Use the Service in violation of any applicable law or regulation
Sexually Explicit Content.
- You may not upload, store, or distribute any sexually explicit visual content, including images or videos depicting graphic sexual acts, explicit nudity intended to arouse, or pornographic material.
- Text-based works that contain erotic or sexually explicit themes must be clearly and accurately labeled as such. Failure to properly label such content may result in removal or account suspension.
- We reserve the right to determine, in our sole discretion, whether content violates this policy.
We may suspend or terminate access if we reasonably believe these Terms have been violated.
4. User Content
You retain ownership of all content you submit, upload, or store through the Service (“User Content”).
By submitting User Content, you grant Dinky, LLC a non-exclusive, worldwide, royalty-free license to host, store, process, and display such content solely for the purpose of operating, maintaining, and improving the Service.
You represent that you have all rights necessary to submit your User Content and that it does not violate any third-party rights or applicable laws.
5. Communications Consent
By creating an account, you consent to receive communications from us, including:
- Account notifications
- Security and service announcements
- Administrative and operational messages
You may opt out of non-essential communications where permitted by law. Essential service-related communications may still be sent.
6. Fees and Payments (If Applicable)

If you purchase a paid plan:

Payments are processed by third-party payment providers. We do not store full payment card details.

Upon termination, your right to use the Service will immediately cease.

To the maximum extent permitted by law, Dinky, LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of data, revenue, or business opportunities.
Our total liability for any claim arising out of or relating to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim, or zero if no fees were paid.

You agree to indemnify and hold harmless Dinky, LLC, its members, officers, and affiliates from any claims, damages, losses, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of applicable laws or third-party rights

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles.
